1. Eligibility: The Sweepstakes is open to persons who are legal residents of the United States (except residents of Puerto Rico and U.S. territories and possessions) and are at least 18 years of age or older, excluding the employees, their families and other persons living in the same household as such employees of Sponsor and its parents, affiliates, subsidiaries, and advertising agencies. The Sweepstakes is void wherever prohibited or restricted and is subject to all applicable federal, state, and local laws.
2. Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of mobileSPA, which are final and binding.
3. Promotional Period: The Sweepstakes begins on January 25, 2006 at 8pm p.m. Eastern Time (ET) and ends on February 25, 2006 at 8pm (ET).
4. How to Enter: To enter using the Internet, access the page located at http://www.mobilespa.com/entry_form.asp and complete all of the information fields required. Then click on the “Submit” button to be registered and receive one entry into the Sweepstakes.
Limit one (1) entry per person during the Promotional Period. Entrants may not enter with multiple email and/or multiple identities nor may entrants use any other device or artifice to obtain more than the maximum number of entries. Any entrant who attempts to participate with multiple email and/or multiple identities or uses any device or artifice to obtain more than the maximum number of entries may be disqualified.
5. Drawings: Winner will be selected by mobileSPA in a random drawing from all eligible entries received during the Promotional Period. Drawing will take place within approximately three (3) business days following the end of the Promotional Period. Winners will be notified by email within approximately five (5) business days of the drawing.
6. General Conditions: mobileSPA reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, mobileSPA reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. mobileSPA reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. mobileSPA's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
7. Release: By entering this Sweepstakes, entrant agrees to release and hold harmless, mobileSPA, and any additional promotional partners, each of their related companies, and each of their respective officers, directors, employees, and agents from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly of indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Sweepstakes, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
8. Limitations of Liability: mobileSPA is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of any prize awarded (vi) the guarantee of satisfaction when experiencing the prize package.
9. Entrant's Personal Information: Information collected from entrants is subject to the mobileSPA Privacy Policy.
